The Yokohama District Court on January 25 ordered a subsidiary of the former major staffing agency, Goodwill, to revoke the dismissal of one of its workers.
In March 2009, a 40-year-old male worker was fired by TECHNOPRO Engineering, Inc., a subsidiary of the former Goodwill Group, Inc. (now Advantage Resourcing Japan, Inc.). The man filed a lawsuit against the company demanding the nullification of his dismissal and payment of back wages.
The ruling pointed out that TECNOPRO did not have an urgent need to lay off the plaintiff and that the company’s criteria for choosing workers to be dismissed were unreasonable.
The court regarded the company’s dismissal of the plaintiff as null and void and ruled that the company should pay him a part of his salary in back pay.
The plaintiff’s lawyers group said, “The ruling agrees with the plaintiff’s argument that company’s dismissal was unjust in light of the four requirements of legitimate dismissal. This ruling is significant in securing non-regular workers’ rights.”
