Former IT company worker wins 4 million yen in back pay for overtime work

A former worker at a subsidiary of a U.S.-based IT company recently received a total of 4.24 million yen in back pay for overtime work through a legal battle, Akahata learned on March 20.

The worker worked at Ansys Japan K.K., whose head office is located in Tokyo’s Shinjuku, from October 2010 to February 2013. During this period, the company paid the worker no overtime as it completely neglected its responsibility to record its employees’ working hours.

The worker in June 2013 filed a lawsuit with the Tokyo District Court against Ansys, demanding that the company pay compensation and 3.51 million yen in unpaid overtime wages.

Since the court battle started, the company showed its intention to settle the case through court mediation. At the second settlement conference in the court, the company accepted the plaintiff’s claims and agreed to issue a cognovit note which is tantamount to finalization of the court’s decision in favor of the plaintiff.

Plaintiff’s lawyer Shimura Shin said, “This outcome will encourage workers to stand up against the corporate illegal labor practice of unpaid overtime.”
