10% of all overtime pay violations at ‘black’ corporations |
The data indicated that in 2012, the number of violations of the regulations regarding extra pay stood at 24,454. Of them, the number of violations committed by “black” corporations reached 2,449.
The survey was conducted in response to a request made by Japanese Communist Party member of the House of Councilors Kira Yoshiko.
The JCP lawmaker on March 11 at a House Budget Committee meeting took up the fact that in help-wanted ads, many corporations using young workers as disposable labor are making the monthly wage, which actually includes overtime pay, appear to be “basic pay”.
Citing that these companies in violation of labor laws evade calculating exact overtime hours and just pay workers the company-set amount of overtime, Kira called on the ministry to carry out a fact-finding survey.
Under the law, when employers want to incorporate a certain amount of overtime pay in a monthly salary, they are required to specify the amount of overtime hours and make additional payments for the number of hours exceeding the specified hours.
