Court nullifies dismissal of private high school teachers

The Osaka High Court on July 15 reversed a lower court decision and nullified the dismissal of five teachers of Kinki University Sensyu High School in Osaka.
The case was filed by the five veteran teachers, who are union members of the Osaka Private School Teachers and Staff Union.
The high school dismissed seven teachers on the grounds of business difficulties in March 2008 and refused to have talks with them. In December 2009, the Osaka District Court’s Sakai branch turned down the plaintiffs’ appeal, ruling in favor of their employer.
The latest ruling, however, recognized that the school abused the right of dismissal, describing the action as “very unjust” and lacking objectively appropriate grounds.
